1. Agreement to Terms

By accessing or using EchoPitch, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not access the service. EchoPitch is operated by Cavefish, a company registered in England and Wales (ICO Registration: ZB915633).

2. Description of Service

EchoPitch provides AI-powered presentation coaching tools that allow users to practice presentations, interviews, and pitches, and receive automated feedback on their performance.

IMPORTANT - PREDICTIVE NATURE: All feedback, scores, assessments, and analysis provided by EchoPitch are predictive estimates only generated by artificial intelligence algorithms. They are NOT guarantees, professional assessments, or definitive evaluations of your abilities or potential outcomes.

The AI-generated feedback represents statistical predictions based on pattern recognition and should be treated as one of many inputs in your preparation process. Actual interview outcomes, presentation success, or career advancement depend on numerous factors beyond the scope of this tool and are entirely outside our control.

3. Account Registration

To use EchoPitch, you must:

Be at least 18 years old or have parental/guardian consent
Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorised access

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to:

Use the service for any unlawful purpose
Upload content that is harmful, offensive, or violates others' rights
Attempt to gain unauthorised access to our systems
Interfere with the proper functioning of the service
Use the service to develop competing products
Resell or redistribute access to the service without permission
Use automated tools to scrape or extract data

5. Content and Intellectual Property

Your Content: You retain ownership of any content you upload to EchoPitch, including practice videos and recordings. By uploading content, you grant us a limited licence to process it for the purpose of providing feedback.

AI Training: We may use anonymised data from your sessions to improve our AI models, as described in our Privacy Policy. You can opt out in settings.

Our Content: EchoPitch, its logo, design, and all associated intellectual property are owned by Cavefish and protected by applicable laws.

6. Subscription and Payments

Free Tier: Limited features are available at no cost.

Paid Plans: Premium features require a paid subscription. Payments are processed securely through our payment provider. Subscriptions renew automatically unless cancelled before the renewal date.

Refunds: We offer refunds in accordance with applicable consumer protection laws. Contact hello@cavefish.ai for refund requests.

7. Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until then. We may also terminate or suspend your account for violation of these terms.

8. Disclaimers and No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO GUARANTEES WHATSOEVER REGARDING:

Any improvement in your presentation, interview, or communication skills
Success in any interview, pitch, presentation, or professional endeavour
The accuracy, reliability, or completeness of any AI-generated feedback, scores, or assessments
Any specific outcome, result, or achievement in your personal or professional life
Uninterrupted, secure, or error-free service availability
That the service will meet your expectations or requirements

ALL FEEDBACK IS PREDICTIVE ONLY: Any scores, ratings, assessments, or suggestions generated by EchoPitch are algorithmic predictions based on statistical patterns. They do not constitute professional advice, expert evaluation, or any form of guarantee. You acknowledge that AI systems can produce errors, inconsistencies, and inaccurate assessments.

EchoPitch is a practice and preparation tool only. It is NOT a substitute for professional coaching, career counselling, mental health treatment for anxiety disorders, or any other professional service. By using this service, you accept full responsibility for how you apply any feedback received and acknowledge that your outcomes depend on factors entirely outside our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAVEFISH LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, business opportunities, or goodwill
Loss of data or cost of procurement of substitute services
Any damages arising from your reliance on AI-generated feedback or predictions
Any unsuccessful interviews, presentations, pitches, or professional outcomes
Any career-related decisions made based on information from the service

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100).

10. Indemnification

You agree to indemnify and hold harmless Cavefish, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these terms.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the modified terms.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where consumer protection laws provide otherwise.

13. Assumption of Risk

By using EchoPitch, you expressly acknowledge and agree that: (a) you use the service entirely at your own risk; (b) you are solely responsible for any decisions or actions you take based on AI-generated feedback; (c) we have no control over interview outcomes, hiring decisions, or any third-party evaluations of your performance; and (d) any scores or assessments provided are statistical estimates that may not reflect your actual abilities or predict real-world outcomes.
